Terms & Conditions

By creating an account or using the FitFab mobile application, website (fitfab.ai), or web application (pulse.fitfab.ai) (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Services.

If you are using the Services on behalf of a company or organization (B2B corporate wellness program), you represent that you have the authority to bind that entity to these Terms.

• You must be at least 16 years of age to use the Services.
• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.

FitFab provides an AI-powered health intelligence platform that:

• Aggregates data from wearable fitness devices into a unified dashboard
• Analyzes food and nutrition through camera-based scanning and AI
• Generates personalized health insights, recommendations, and gap analyses
• Offers an AI health advisor for conversational guidance
• Provides corporate wellness dashboards with anonymized aggregate data (B2B)

4.1 Individual Accounts (B2C)

Individual users sign up directly and are billed on a per-user subscription basis. You own and control all your health data.

4.2 Corporate Accounts (B2B)

Companies may create organizational accounts for employee wellness programs. Corporate account roles include Owner, Admin, Operations, and Employee/Member. Individual employee health data remains private; corporate dashboards display only anonymized aggregates with a minimum group size of 5 employees.

You agree to:

• Use the Services only for lawful purposes
• Not attempt to reverse-engineer, decompile, or disassemble the Services
• Not interfere with or disrupt the integrity or performance of the Services
• Not use automated scripts or bots to access the Services without our prior written consent
• Not impersonate another person or misrepresent your affiliation
• Not upload malicious content, viruses, or any material that infringes intellectual property rights

FitFab is not a medical device and does not provide medical advice. The insights, recommendations, and data presented through the Services are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or health condition.

• Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or health regimen.
• Do not disregard professional medical advice or delay seeking it because of information provided by FitFab.
• In case of a medical emergency, contact your local emergency services immediately.
• Wearable device data may contain inaccuracies. FitFab is not responsible for the accuracy of data from third-party devices.

All content, features, and functionality of the Services — including text, graphics, logos, icons, software, AI models, and algorithms — are the exclusive property of FitFab Inc. and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or authorized business purposes in accordance with these Terms.

• Subscriptions are billed on a recurring basis (monthly or annually) as selected during sign-up.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are handled in accordance with the applicable app store policies (Apple App Store or Google Play Store).
• We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Services, you consent to the data practices described in the Privacy Policy.

The Services integrate with third-party wearable devices, health platforms, and data providers (e.g., Apple HealthKit, Fitbit, Garmin, USDA FoodData Central). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party integrations is subject to their respective terms and conditions.

To the maximum extent permitted by law, FitFab Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Services
• Any health decisions made based on information provided by the Services
• Inaccuracies in wearable device data or nutrition analysis
• Unauthorized access to or alteration of your data
• Any third-party conduct or content

Our total liability for any claim arising from the Services shall not exceed the amount you paid to FitFab in the 12 months preceding the claim.

You agree to indemnify and hold harmless FitFab Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to the Services, other users, or FitFab. Upon termination, your right to use the Services will immediately cease. You may request export of your data within 30 days of termination.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
